Personal Bankruptcy Option: Chapter 7
While Chapter 7 bankruptcy is available to businesses who are willing to liquidate, it is most often used by individuals who are far into debt and do not have the financial means (as determined by the Chapter 7 means test) to pay their creditors. Also called "fresh start" bankruptcy, Chapter 7 completely eliminates your non-exempt debt, including credit card debt, medical bills and more.

Personal Bankruptcy Option: Chapter 13
Chapter 13 bankruptcy allows individual debtors to negotiate a reorganization plan to keep their assets, avoid foreclosure and reduce the financial burden they face. Chapter 13 reorganization is very similar to Chapter 11. Debtors work with the court to develop a plan to pay your debts in installments over a three to five year period. A Chapter 13 bankruptcy will stop collection efforts.
